CHAVEZ WILL BE BROUGHT BEFORE THE INTERNATIONAL CRIMINAL COURT, THE HAGUE

Un grupo de organizaciones de la sociedad civil venezolana ha introducido una petición ante la Corte Penal Internacional, basada en La Haya, a fin de que se aboque a la investigación de los documentos encontrados en las computadores del difunto terrorista Raúl Reyes y establezca la conexión, si es que existe, entre las FARC y el presidente Hugo Chávez. Apoyamos y participamos plenamente en esta iniciativa, en nuestra condición de Asesor General de RECIVEX.

A group of organizations of Venezuelan civil society has introduced a petition to the International Criminal Court, based in The Hague, to investigate the documents found in the laptops of the deceased leader of the terrorist Colombian guerrillas, FARC., in order to establish the connection, if any, between Venezuelan President Hugo Chavez and this terrorist organization. I fully support this petition, in my condition of General Adviser to RECEIVEX.

The Plataforma Democrática de Venezolanos en Madrid, PDVM (Democratic Platform of Venezuelans in Madrid), Frente Iberoamericano por la Libertad, FIAL (Iberoamerican Freedom Front), Asociación de Madres y Mujeres Venezolanas en el Exilio, AMAVEX, (Venezuelan Association of Mothers and Women in Exile), Resistencia Civil de Venezolanos en el Exterior, RECIVEX (Civil Resistance of Venezuelans Abroad), and organized civil society wish to announce the following to public opinion:
Last March 1, during an incursion into a camp of the narcoterrorist wing of the FARC, the Colombian army captured of the computers of Raul Reyes, second in command of this guerrilla group and who perished during the operation. Soon afterward, the Colombian government advised that the contents of the cited computers reveal the presumed links between the President of Venezuela Hugo Chavez Frías and this guerrilla group.
On Monday, March 3, the president of Colombia, Álvaro Uribe announced that:‘Colombia proposes to accuse Hugo Chavez, the president of Venezuela, before the International Criminal Court (ICC), of sponsorship and financing of genocide.’
Therefore, on March 14, the organizations that sign this communiqué asked Dr. Luis Moreno Ocampo, a Prosecutor for the International Criminal Court (ICC) in accordance with articles 13 and 15 of the Statute of Rome, to request the authorization of the Pre-Trial Chamber of the ICC to open an investigation into the contents of these computers. The basis of this request is, as has been announced and verified by INTERPOL on May 15, the presence of indications that suggest the criminal responsibility of president Hugo Chavez Frías, as a collaborator, financier, and accomplice of the FARC in its criminal behavior, which we believe must be clarified by a jurisdictional organization.
In accordance with the Statute of Rome, the ICC only opens trials in those cases in which national jurisdictions have failed to process certain crimes or refuse to do so. It is evident that the cited judicial investigation will not be initiated in Venezuela, and that any investigation that may be begun in Colombia cannot commit a head of state of a country with which it maintains diplomatic relations, thanks to the Doctrine of “Sovereign Immunity”. For this reason, the undersigned have requested the establishment of the supplemental jurisdiction of the International Criminal Court, as this court would be competent to judge heads of state in the exercise of their duties, especially when taking into account that on May 30, Prosecutor Luis Moreno Ocampo publicly declared that the narcoterrorist FARC guerrillas had committed crimes Against Humanity.
This request, to investigate the connections that may link the President of the Venezuelan government as a collaborator with terrorist groups, is in addition to what the Office of the Prosecutor of the ICC calls the “Case of Venezuela”, which is an evaluation of the possibility of investigating Crimes against Humanity and violations of Human Rights that have occurred in Venezuela during the last 5 years; a case that, as shown in the attached communication from the Office of the Prosecutor, is current in the phase of study and analysis.
For this reason, our organizations, with the support of organized civil society, have begun an international campaign called “BRING CHAVEZ TO JUSTICE”, in order to sensitize the international community on this serious matter. This campaign is intended to seek and obtain the greater possible support for the complaint, to bring Hugo Chavez to international justice to face his responsibility for the events in which he is involved. On June 4, we delivered a letter to the president of the European Parliament, Mr. Hans-Gert Pöttering, to advise him of our request to the ICC and to inform him and the members of the European Parliament of the start of this campaign, which seeks the support and backing from international institutions and organizations to create a climate of opinion that would promote this investigation.
Several worldwide non-governmental organizations have already been supportive of our request. This request is also being promoted on the Internet, where tens of thousands of signatures have been obtained from citizens who support this measure, in Venezuela and internationally.

***CASO VENEZUELA - CORTE PENAL INTERNACIONAL
VENEZOLANOS SOLICITAN JUZGAR A CHAVEZ POR PATROCINIO Y FINANCIACION DE LAS FARC.




La Plataforma Democrática de Venezolanos en Madrid (PDVM), el Frente Iberoamericano por la Libertad (FIAL), la Asociación de Madres y Mujeres Venezolanas en el Exilio (AMAVEX), la Resistencia Civil de Venezolanos en el Exterior (RECIVEX) y la sociedad civil organizada, quieren hacer del conocimiento de la opinión pública lo siguiente:
El 1 de Marzo pasado, la incursión del ejército colombiano en un campamento del grupo narco terrorista de las FARC, permitió incautar las computadoras de Raul Reyes, 2do. líder en la cadena de mando de este grupo guerrillero y quien pereciera durante la operación. Seguidamente, el gobierno colombiano informó que del contenido encontrado en las citadas computadoras se desprendía la presunta vinculación del Presidente de Venezuela Hugo Chávez Frías con el mencionado grupo guerrillero.
El lunes 3 de Marzo el presidente de Colombia, Álvaro Uribe anuncio publicamente:“Colombia se propone, en la Corte Penal Internacional (CPI), denunciar a Hugo Chávez, presidente de Venezuela, por patrocinio y financiación de genocidas”.
Por tal motivo, el pasado 14 de Marzo, las organizaciones que suscriben el presente comunicado, solicitamos al Dr. Luis Moreno Ocampo, Fiscal de la Corte Penal Internacional (CPI) que, de conformidad con lo dispuesto en los artículos 13 y 15 del Estatuto de Roma, solicitara la autorización de la Sala de Cuestiones Preliminares de la CPI para abrir una investigación del contenido de estas computadoras. Esta solicitud se basa en que, de acuerdo a lo informado hasta ahora y que ha sido verificado por
INTERPOL el 15 de Mayo, existen serios indicios que comprometen la responsabilidad penal del presidente Hugo Chávez Frías, como colaborador, financista y cómplice de las FARC en su actuación criminal, lo cual consideramos debe ser necesariamente aclarado por un órgano jurisdiccional.
Conforme a lo establecido en el Estatuto de Roma, la CPI solamente abre juicios en aquellos casos en que las jurisdicciones nacionales hayan fallado a la hora de procesar ciertos crímenes o se nieguen a hacerlo. Por esta razón, dado que resulta evidente que en Venezuela no se dará inicio a la citada investigación judicial, y que la que se inicie en Colombia no puede comprometer a un jefe de estado de un país con el que se mantienen relaciones diplomáticas gracias a la Doctrina de la “Inmunidad de Soberanía”; quienes suscriben, hemos solicitado la activación de la jurisdicción supletoria de la Corte Penal Internacional, ya que esta corte si tendría competencia para juzgar a jefes de estado en ejercicio de su cargo, más aún tomando en cuenta que ya el pasado 30 de Mayo, el Fiscal Luis Moreno Ocampo declaró a la opinión pública, que la guerrilla narco-terrorista de las FARC ha cometido crímenes de Lesa Humanidad.
Esta solicitud, que pretende investigar los nexos que vincularían al Presidente del gobierno venezolano como colaborador de grupos terroristas, se suma a lo que en la Fiscalía de la CPI se conoce como el “Caso Venezuela”, por el que se evalúa la posibilidad de investigar los crímenes de Lesa Humanidad y las violaciones a los Derechos Humanos ocurridas en Venezuela durante los últimos 5 años; caso que, como se desprende de la comunicación anexa que nos hiciera llegar la citada Fiscalía, se encuentra en fase de estudio y análisis.
Por esta razón, nuestras organizaciones con el apoyo de la sociedad civil organizada han puesto en marcha una campaña internacional denominada “JUZGAR A CHAVEZ”, dirigida a sensibilizar a la comunidad internacional sobre este grave asunto, y a través de la cual se pretende solicitar y obtener el mayor respaldo posible a la denuncia presentada, a fin de llevar a Hugo Chávez ante la justicia internacional para que enfrente su responsabilidad en los hechos que le comprometen. El 4 de Junio, entregamos una carta al presidente del Parlamento Europeo, Hans-Gert Pöttering, con el objetivo de informar de nuestra solicitud en la CPI y hacer de su conocimiento y la de los miembros del Parlamento Europeo, el inicio de esta campaña que busca apoyo y respaldo de las instituciones y organismos internacionales que puedan crear un clima de opinión que promueva dicha investigación.

Hasta este momento numerosas organizaciones no gubernamentales a nivel mundial se han adherido a nuestra solicitud. Así mismo, esta denuncia también está siendo promovida por las redes de internet, en las que ya suman decenas de miles de firmas de ciudadanos apoyando esta medida en Venezuela y a nivel internacional.
